AMichigan Supreme Court hearing was held on Wednesday, as judges hear oral arguments in a lawsuit challenging Governor Gretchen Whitmer’s powers to issue executive orders. A group of medical professionals in West Michigan filed the suit after the governor banned nonessesntial medical procedures during the COVID pandemic. They say the executive order hurt them financially, and negatively affected their patients’ care.
The case challenges Whitmer’s unprecedented use of emergency powers, which resulted in her possessing unilateral control over all state policies related to COVID-19. The Mackinac Center Legal Foundation, in conjunction with Miller Johnson, are representing three medical practices that were unable to provide necessary care and a patient who was unable to receive care under the governor’s previous orders.

“The Michigan Supreme Court now has the opportunity to restore proper representation to the 10 million people in our state. As many of the justices’ questions demonstrated, the governor cannot continue to exert unilateral and unchecked power. It is time to return to our normal constitutional system.”
