On 06/02/2026 at approximately 9:14pm the Marquette Police Department responded to 616 W. Baraga Ave. Apt. 1 for a 911 call reporting a disturbance between multiple subjects. Upon arrival officers located a male victim with apparent gunshot wounds inside the apartment. A second male victim was also located in the apartment with minor injuries.
Information from the victims on scene identified the suspect as an occupant of the residence where the incident occurred. Officers also received information that the suspect had fled the scene in a vehicle owned by one of the victims.
A Be on the Lookout (BOL) was aired for the suspect and vehicle. The vehicle was observed a short time later by a Michigan State Police Trooper on US-41 in Negaunee Township. The vehicle increased in speed and fled from the Trooper westbound.
A pursuit was initiated. As the vehicle was traveling westbound on US-41 in the City of Negaunee, it departed the south side of the highway at a high rate of speed and struck diesel fuel pumps located at the Krist gas station. The crash caused the vehicle and pumps to catch fire. The suspect was able to exit the vehicle and was taken into custody.
The victim who sustained gunshot injuries is a 33-year-old Marquette man. He was transported from the scene to UPHS-Marquette for treatment of his injuries. He remains hospitalized in stable condition.
The victim who sustained minor injuries during the incident is a 68-year-old Marquette man. He was transported from the scene to UPHS-Marquette following the incident for treatment of non-gunshot injuries. He was released from the hospital following treatment.
The suspect, Trevor Caponcello Restivo, a 31-year-old Marquette man, sustained injuries from the vehicle crash. He was transported to UPHS-Marquette for treatment. Restivo remained at the hospital in the custody of the Marquette Police Department until his discharge on 06/04/2026.
Following his release from the hospital, Restivo was lodged at the Marquette County Jail on the following ten (10) charges which were authorized by the Marquette County Prosecutor’s Office on 06/03/2026:
Two (2) counts of Assault with Intent to Murder
One (1) count of Weapons – Firearms – Discharge in or at a Building Causing Serious Impairment
One (1) count of Weapons – Firearms – Discharge in or at a Building Causing Injury
Four (4) counts of Weapons Felony Firearm
One (1) count of Interfering with Electronic Communications Causing Injury or Death
One (1) count of Police Officer – Fleeing – Second Degree
